Terms of Service

1. Definitions

“Service.” The Service means Service Pilot Marketing LLC’s software platform and related applications, tools, features, updates, documentation, support, and ancillary services, including but not limited to CRM, automations, workflows, campaigns, forms, websites, funnels, courses, and other proprietary materials made available by Service Pilot Marketing LLC (“SPM”).

“User” or “You.” Any individual or entity accessing or using the Service, including their employees, agents, contractors, and representatives.

Service Terms

The Service provides tools for customer relationship management, data management, automated workflows, communications, marketing, analytics, and reporting. Users must comply with all applicable laws, including data protection, privacy, marketing, intellectual property, and telemarketing regulations.

Governing Law; Venue

These Terms are governed by the laws of the State of Idaho, without regard to conflicts-of-law rules. Except for claims seeking injunctive relief regarding SPM’s intellectual property or confidential information, disputes are resolved by binding arbitration under Section 14. You consent to jurisdiction in the state and federal courts of Ada County, Idaho.

TCPA / Voice AI Consent Language (Add-On)

By submitting your contact information or interacting with SPM’s forms, chatbots, or voice agents, you expressly consent to receive marketing communications via SMS, phone calls, email, or automated/AI-assisted systems. You understand that consent is not a condition of purchase and that you may opt out at any time by replying STOP or contacting [email protected].

Beta Features Disclaimer (Add-On)

From time to time, SPM may provide access to beta, experimental, or early-release features ('Beta Features'). Beta Features are provided 'as-is' without warranty and may be modified or discontinued at any time. SPM disclaims any liability arising from use of Beta Features.

DMCA Notice Procedure (Add-On)

If you believe that material available through the Service infringes your copyright, please submit a written notification including: (1) your physical or electronic signature, (2) identification of the copyrighted work, (3) the infringing material’s location, (4) your contact details, and (5) a statement of good-faith belief that the use is not authorized. Data Processing Addendum (DPA) (Add-On)

For customers subject to GDPR or similar data protection laws, SPM offers a Data Processing Addendum (DPA) incorporating Standard Contractual Clauses (SCCs) for cross-border data transfers. To request a DPA, contact [email protected].
